Türkiye'de Kurulan Üniversitelerin Yasal Gerekçelerinin İncelenmesi

Abstract

Bir toplum için; kendi insan gücü ve maddi kaynakların, çağdaş bilimsel ve teknolojik gereklerin rasyonel ve ekonomik şekilde kullanılmasında en büyük pay üniversitelere düşmektedir. Bir üniversitenin doğuşu ise uzun yıllar içinde gerçekleşen önemli, ekonomik ve toplumsal bir olaydır. Üniversitelerin ülke düzeyindeki dağılımı bir devlet politikasıdır ve 1982 Anayasası’nın 130. maddesi üniversitelerin yasayla kurulacağını hükme bağlamıştır. Türkiye’de bu karar verme organı ise Türkiye Büyük Millet Meclisidir. Bu çalışma ile Cumhuriyetin İlanından günümüze kadar geçen süreçte kurulan üniversitelerin yasal gerekçelerinin tespit edilmesi amaçlanmıştır. Bu kapsamda çalışma evrenini Türkiye’de kurulan “devlet üniversiteleri” oluşturmuştur. Çalışmada, nitel araştırma yaklaşımı benimsenmiş olup üniversitelerin kurulma gerekçelerini ortaya koyabilmek için yasa metinleri incelenmiştir. Yapılan inceleme ile üniversitelerin kurulmalarında yatan temel yasal düşüncenin kentin ekonomik, kültürel ve sosyal hayatını canlandırmak ve fırsat eşitliği ilkesine göre herkesin yaşadığı kenti üniversite olanağına kavuşturmak olduğu sonucuna varılmıştır.

Universities play the biggest role in the use of contemporary, scientific and technological requirements in the rational and economical way of society. The establishment of a university is an important, economic and social event that takes place over many years. The distribution of universities within the country is a state policy. Article 130 of the 1982 Constitution stipulates that universities will be established by law. This decisionmaking body in Turkey is the Grand National Assembly of Turkey. With this study, it was aimed to determine the legal reasons of the universities established in the period from the proclamation of the Republic to the present day. In this context, ‘State Universities’ established in Turkey have formed the working universe. In the study, qualitative research approach was adopted and the texts of the law were examined in order to reveal the reasons for the establishment of universities. As a result of the research, it was determined that the main political idea in the establishment of universities was to revive the economic, social and cultural life of the city and to allow the city where everyone lives to university according to the principle of equality of opportunity.
